1. Acceptance of the terms

By downloading, registering or using MyNEXO ("the App"), you accept these Terms & Conditions in their current version. If you do not agree, uninstall the App and do not use it.

MyNEXO is operated by Agustín Gallea / MyNEXO Group, based in Málaga, Spain. NIF: Z0604987T.

2. Service description

MyNEXO is an intermediary platform that allows the LGBTQI+ community to create, discover and join local events, with chat, notifications and social profile features.

3. Usage requirements

• Be at least 18 years old. Registration of minors is strictly prohibited.
• Provide truthful, current and complete information upon registration.
• Have legal capacity to enter into binding contracts.
• Have an internet connection and a device compatible with the App.

4. User account

You are solely responsible for keeping your credentials confidential and for all activity carried out under your account. Notify us immediately of any unauthorized use at support@mynexoapp.site.

The Operator may suspend or delete accounts without prior notice in cases of: breach of these T&C, abusive behavior, publication of illegal content, or risk of harm to third parties or the platform.

5. Prohibited conduct

• Illegal activities (drug trafficking, human trafficking, etc.)
• Discriminatory, violent, harassing or non-consensual explicit content
• Any material involving, harming or sexualizing minors (CSAM)
• Advertising, soliciting or facilitating paid sexual services (contrary to FOSTA-SESTA — see section 16)
• Spam, identity theft, phishing or fraudulent events
• Unauthorized access, reverse engineering, scraping or attacks on the infrastructure
• Creating fake or multiple accounts to evade sanctions or restrictions
• Commercial use of the platform without the Operator's express authorization

6. Private events

The organizer is solely responsible for the content and conduct of private events. The private nature of an event on the platform does not exempt anyone from compliance with applicable law.

7. Organizer responsibility

The organizer is solely responsible for the organization, safety, administrative permits (licenses, insurance, capacity), legality and conduct of their events. The Operator shall not be liable for injuries, damages, losses or incidents occurring during, before or after events.

8. Adult content between participants

In private or approval-gated events, participants over 18 may share photos with each other after expressly accepting the adult-content notice shown in the App.

• Any material involving or sexualizing minors is absolutely prohibited and will be reported immediately to law enforcement.
• Distribution of intimate images without the express consent of the person concerned is prohibited.
• Chat photos are automatically deleted 90 days after the event ends.
• The Operator may remove content and suspend accounts upon a substantiated report, without prior notice in urgent cases.

9. Payments and subscriptions

Payments are managed via RevenueCat through App Store (iOS) and Google Play (Android). By paying, you also accept the terms of RevenueCat.

• App Store purchases (iOS): subject to Apple Media Services Terms and Conditions. Apple handles billing and refunds for iOS in-app purchases.
• Google Play purchases (Android): subject to Google Play Terms of Service. Google handles billing and refunds for Android in-app purchases.
• Right of withdrawal (EU, 14 days): you have 14 calendar days from contracting to withdraw at no cost. Write to support@mynexoapp.site with your name, email and purchase date.
• Pro subscription: renews automatically at the end of each period. Cancel at any time from Profile → Settings → Subscription or from the App Store / Google Play; takes effect at the end of the contracted period.
• Subscription refund: if you cancel within the withdrawal period and have not used the Pro plan, the full amount is refunded within 7 days.
• Paid events: the refund policy is set by the organizer. If the organizer cancels a paid event, they are solely responsible for managing refunds to attendees.

10. Privacy, personal data and profiling

The processing of your data is governed by our Privacy Policy, which forms an integral part of these T&C.

The App uses your preferences (energy, audience, city) to personalize the events shown to you. This constitutes profiling under art. 4.4 GDPR. You have the right to object to such profiling by writing to support@mynexoapp.site.

11. Intellectual property

The name "MyNEXO", the logo, the design and the source code of the App are the exclusive property of the Operator and are protected by intellectual and industrial property law.

By publishing content on the platform (texts, photos, event descriptions), you grant the Operator a non-exclusive, free, revocable license limited to the scope of the App to display, reproduce and distribute such content exclusively in the context of the service. This license ends when you delete the content or your account.

13. Governing law and dispute resolution

These T&C are governed by Spanish law as the base law, given that the Operator is resident in Spain.

For consumer disputes, you have access to the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Disputes not resolved out of court are submitted to the Courts and Tribunals of Málaga, Spain, except as provided in sections 15 and 16 for users in Latin America and the United States.

15. Supplemental provisions for Latin America

If you access MyNEXO from a Latin American country, the following additional conditions apply:

• Language: these T&C are also available in Spanish as the primary language. In case of discrepancy, the Spanish version prevails.
• Minors: use of MyNEXO is prohibited for persons under 18 in all countries of the region.
• Payments: in-app payments are processed in euros (EUR) through App Store or Google Play. The user assumes any currency conversion costs charged by their financial institution.
• Events: the organizer is responsible for complying with local law in the country where the event takes place (permits, capacity, health regulations, etc.).
• Sensitive data: information about sexual orientation and gender identity is optional and governed by the data protection law of the user's country.
• Dispute resolution — Brazil: users in Brazil may turn to their state PROCON or the Defesa do Consumidor system (art. 101, CDC) for consumer disputes.
• Dispute resolution — Argentina: users in Argentina may turn to the Dirección Nacional de Defensa del Consumidor for consumer claims.
• Dispute resolution — Mexico: users in Mexico may turn to PROFECO (Procuraduría Federal del Consumidor) for consumer disputes.

16. Supplemental provisions for the United States

FOSTA-SESTA compliance

MyNEXO complies with the Allow States and Victims to Fight Online Sex Trafficking Act / Stop Enabling Sex Traffickers Act (FOSTA-SESTA, 18 U.S.C. §§ 1591, 2421A). The following is absolutely prohibited on the platform:

• Promoting, facilitating or advertising prostitution
• Soliciting, contracting or arranging paid sexual services (in cash or any other form of compensation)
• Any activity constituting sex trafficking or sexual exploitation
• Content designed to recruit, coerce or transport persons for sexual exploitation

Arbitration agreement and class action waiver

For users in the United States, any dispute, claim or controversy arising from these T&C or the use of MyNEXO shall be resolved by individual binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless prohibited by applicable law.

• You waive the right to initiate or participate in class actions against MyNEXO.
• Arbitration will be conducted in English or Spanish, at your choice.
• This clause does not apply to claims under USD 10,000, which may be brought in small claims court.

Applicable law — USA

• California: CCPA/CPRA rights are respected. We do not sell personal data to third parties.
• All states: MyNEXO does not carry out targeted advertising or profiling for commercial purposes.
• COPPA: if you are under 13 (or under 16 in California), you are prohibited from using MyNEXO.

Limitation of liability — USA

To the maximum extent permitted by applicable law, MyNEXO shall not be liable for indirect, incidental, special, consequential or punitive damages. The Operator's total liability to any US user shall not exceed the amount paid by that user in the 12 months prior to the claim, or USD 100 if no payment has been made.

Section 230 — Communications Decency Act

MyNEXO acts as an intermediary platform for user-generated content. Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), MyNEXO is not liable for content published by third parties on the platform, including event descriptions, chat messages or user profiles. Note: Section 230 immunity does not apply to content that violates FOSTA-SESTA (see above).
