Last updated: October 2026 · Version 1.5
1. Acceptance of the terms
By downloading, registering or using MyNEXO ("the App"), you accept these Terms & Conditions in their current version. If you do not agree, uninstall the App and do not use it.
MyNEXO is operated by Agustín Gallea / MyNEXO Group, based in Málaga, Spain. NIF: Z0604987T.
2. Service description
MyNEXO is an intermediary platform that allows the LGBTQI+ community to create, discover and join local events, with chat, notifications and social profile features.
The Operator acts as a hosting service provider under art. 6 of Regulation (EU) 2022/2065 on Digital Services (DSA) and art. 16 of Directive 2000/31/EC. The Operator does NOT organize, sponsor or endorse any of the events published by users.
3. Usage requirements
- Be at least 18 years old. Registration of minors is strictly prohibited.
- Provide truthful, current and complete information upon registration.
- Have legal capacity to enter into binding contracts.
- Have an internet connection and a device compatible with the App.
4. User account
You are solely responsible for keeping your credentials confidential and for all activity carried out under your account. Notify us immediately of any unauthorized use at support@mynexoapp.site.
The Operator may suspend or delete accounts without prior notice in cases of: breach of these T&C, abusive behavior, publication of illegal content, or risk of harm to third parties or the platform.
5. Prohibited conduct
- Illegal activities (drug trafficking, human trafficking, etc.)
- Discriminatory, violent, harassing or non-consensual explicit content
- Any material involving, harming or sexualizing minors (CSAM)
- Advertising, soliciting or facilitating paid sexual services (contrary to FOSTA-SESTA — see section 16)
- Spam, identity theft, phishing or fraudulent events
- Unauthorized access, reverse engineering, scraping or attacks on the infrastructure
- Creating fake or multiple accounts to evade sanctions, restrictions or plan limits
- Commercial use of the platform other than publishing one's own events or events shared under clause 7b (for example, reselling data or advertising unrelated to events) without the Operator's express authorization
Non-compliance may result in permanent suspension, content removal and reporting to the competent authorities. The Operator will cooperate with law enforcement upon any lawful request.
6. Private events
The organizer is solely responsible for the content and conduct of private events. The private nature of an event on the platform does not exempt anyone from compliance with applicable law.
7. Organizer responsibility
The organizer is solely responsible for the organization, safety, administrative permits (licenses, insurance, capacity), legality and conduct of their events. The Operator shall not be liable for injuries, damages, losses or incidents occurring during, before or after events.
7a. Event pricing and fair use of the Free plan
The organizer must state the cost of their event truthfully. If they charge to take part, they must publish it as a paid event. If something has to be paid at the venue (entry, minimum spend or similar) even though the organizer does not charge, they must indicate it with the option "Is there something to pay at the venue?".
- Unlimited free events: the Free plan allows publishing free events with no limit on their number. Events are considered free when neither the organizer nor the venue charges to attend.
- Paid event limit: paid events and events with a cost at the venue are subject to the monthly limit of the plan in use (1 per month on the Free plan).
- Organizations and businesses: associations, collectives, venues and businesses may publish their own events on MyNEXO.
- It is prohibited to: (a) publish as free an event that is not free, or hide its cost; (b) use several accounts, one's own or third parties', to publish events of the same organization or business and thereby exceed the plan limits; (c) mass-publish promotional content that does not correspond to real events.
The Operator may remove events that breach this clause and suspend the accounts involved. The affected user may appeal the decision as set out in the content reporting section.
7b. Shared events, claims and removal requests
You can post on MyNEXO an event you do not organize (the “I’m sharing it” option) to help people discover it. In that case:
- Public events only: it must be an event openly announced by its organizer. Private events and private gatherings may not be shared.
- Accurate details and source: you must state who organizes it, link its official source (website, social media or ticketing) and keep the information up to date.
- Content: you declare that you have the right to use the images and texts you upload; if you do not, use your own description and image.
- No charging, no impersonation: you may not present yourself as the organizer or charge attendees. Tickets, bookings, payments and conditions are always with the organizer. Posting a shared event does not imply any agreement between MyNEXO or the person sharing it and its organizer.
- Claims: the actual organizer may claim the event. If the person who shared it confirms, or the Operator verifies it, the event moves to the organizer’s account together with its attendee list, chat and photos.
- Removal requests: the organizer may ask for their event to be removed. The person who shared it cannot reject that request; the Operator will handle it and may verify the identity of the requester.
- Limits: shared events are subject to the same plan limits as your own events.
The Operator may remove shared events that breach this clause or whose organizer requests removal, and suspend accounts that abuse this feature.
7c. Place listings created by MyNEXO
MyNEXO may show on the map listings of places (bars, clubs, saunas, cafés, hotels, cultural venues and others) created by the Operator from public information, so the community can find them.
- Criteria: only places that publicly present themselves as LGBTQI+ or LGBTQI+-friendly are included.
- Content: the listing states that it was created by MyNEXO, includes no photos or logos of the venue, and its opening hours are approximate.
- Claims: the venue owner may claim the listing; once their identity is verified, the details move to their venue account.
- Removal: the owner may ask for the listing to be removed; the Operator will remove it after a reasonable check.
- Errors: any user may report an error (closure, hours, address) and the Operator will review it.
Listing information is approximate. The Operator does not guarantee its accuracy or that the place is open, and is not responsible for the services provided by the venue.
8. Adult content between participants
In private or approval-gated events, participants over 18 may share photos with each other after expressly accepting the adult-content notice shown in the App.
MyNEXO does not pre-moderate the content of private chats between consenting adults. Each user is solely responsible for the content they publish. By sharing an image you confirm: (a) you have the right to share it, (b) everyone involved is over 18 and has consented, and (c) the content complies with applicable law. Cover photos and profile photos are automatically scanned by Google Cloud Vision SafeSearch before publication.
- Any material involving or sexualizing minors is absolutely prohibited and will be reported immediately to law enforcement.
- Distribution of intimate images without the express consent of the person concerned is prohibited.
- Chat photos are automatically deleted 90 days after the event ends.
- The Operator may remove content and suspend accounts upon a substantiated report, without prior notice in urgent cases.
9. Payments and subscriptions
Payments are managed via RevenueCat through App Store (iOS) and Google Play (Android). By paying, you also accept the terms of RevenueCat.
- App Store purchases (iOS): subject to Apple Media Services Terms and Conditions. Apple handles billing and refunds for iOS in-app purchases.
- Google Play purchases (Android): subject to Google Play Terms of Service. Google handles billing and refunds for Android in-app purchases.

- Pro subscription: renews automatically at the end of each period. Cancel at any time from Profile → Settings → Subscription or from the App Store / Google Play; takes effect at the end of the contracted period.
- Subscription refund: if you cancel within the withdrawal period and have not used the Pro plan, the full amount is refunded within 7 days.
- Paid events: the refund policy is set by the organizer. If the organizer cancels a paid event, they are solely responsible for managing refunds to attendees.
10. Privacy, personal data and profiling
The processing of your data is governed by our Privacy Policy, which forms an integral part of these T&C.
The App uses your preferences (energy, audience, city) to personalize the events shown to you. This constitutes profiling under art. 4.4 GDPR. You have the right to object to such profiling by writing to support@mynexoapp.site.
11. Intellectual property
The name "MyNEXO", the logo, the design and the source code of the App are the exclusive property of the Operator and are protected by intellectual and industrial property law.
By publishing content on the platform (texts, photos, event descriptions), you grant the Operator a non-exclusive, free, revocable license limited to the scope of the App to display, reproduce and distribute such content exclusively in the context of the service. This license ends when you delete the content or your account.
12. Limitation of liability
MyNEXO is provided "as is" with no guarantee of continuous availability or absence of errors. The Operator shall not be liable for: (a) indirect damages, loss of profit or loss of data; (b) acts or omissions of users; (c) content published by third parties; (d) service interruptions due to technical causes or force majeure.
The Operator's maximum liability towards the user is limited to the amount actually paid in the 12 months prior to the incident. This limitation does not apply in case of willful misconduct or gross negligence, nor to non-waivable consumer rights under applicable law.
13. Governing law and dispute resolution
These T&C are governed by Spanish law as the base law, given that the Operator is resident in Spain.
For consumer disputes, you have access to the European online dispute resolution platform: ec.europa.eu/consumers/odr.
Disputes not resolved out of court are submitted to the Courts and Tribunals of Málaga, Spain, except as provided in sections 15 and 16 for users in Latin America and the United States.

FOSTA-SESTA compliance
MyNEXO complies with the Allow States and Victims to Fight Online Sex Trafficking Act / Stop Enabling Sex Traffickers Act (FOSTA-SESTA, 18 U.S.C. §§ 1591, 2421A). The following is absolutely prohibited on the platform:

- Any activity constituting sex trafficking or sexual exploitation
- Content designed to recruit, coerce or transport persons for sexual exploitation
Accounts that violate this policy will be immediately suspended and reported to the competent authorities, including the National Center for Missing & Exploited Children (NCMEC) and the FBI. MyNEXO will cooperate fully with law enforcement agencies upon any lawful request.
Arbitration agreement and class action waiver
For users in the United States, any dispute, claim or controversy arising from these T&C or the use of MyNEXO shall be resolved by individual binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless prohibited by applicable law.
- You waive the right to initiate or participate in class actions against MyNEXO.
- Arbitration will be conducted in English or Spanish, at your choice.
